GĂNȚOI, FURCULIȚA ȘI ASOCIAȚII SPARL, a Professional Society of Lawyers with Limited Liability, with registered office in Bucharest, Splaiul Unirii no. 165, TN Offices 2, Parter, Sala 3, Sector 3 (hereinafter, " GĂNȚOI, FURCULIȚA ȘI ASOCIAȚII " / "GFA") is the Operator of personal data. GĂNȚOI, FURCULIȚA ȘI ASOCIAȚII undertakes to ensure the confidentiality and security of information and personal data belonging to the data subjects entrusted to it, which have been collected online through the website.

We will process data that has been disclosed by online visitors, through their actions on the GĂNȚOI, FURCULIȚA ȘI ASOCIAȚII website, respectively: by activating the option to receive information or news from us, to be able to provide that information, to provide the requested services or to provide information about collaboration opportunities within GĂNȚOI, FURCULIȚA ȘI ASOCIAȚII.

"GDPR" Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation)

"User/data subject" refers to a person who uses the Website, the natural person whose data is processed.

  2. COLLECTION AND USE OF PERSONAL DATA

We collect personal information about you, such as, but not limited to: name, first name, email address, phone number, country of residence, if applicable, organization you represent, position, images, data contained in the curriculum vitae (CV).

When you submit personal data to us, we will use it as described in this Privacy Policy. Your personal information is not used for other purposes, unless we obtain your permission or the law or professional standards require or permit us to use this information.

If you send us a curriculum vitae (CV) or cover letter to apply online for a collaboration opportunity with us, we will use the information you provide to compare it with employment opportunities within GĂNȚOI, FURCULIȚA ȘI ASOCIAȚII that are available. Documents will be kept for a limited period.

In cases where you choose to send us a request, using the contact details indicated on this Website, we will process the data you voluntarily provide us, in order to respond to your request.

  • We may process the data provided in the use of the Website and for the prevention of fraud or criminal activity and the protection of computer systems.

   b. We process the data based on your consent (according to art. 6 paragraph 1 letter a of Regulation 679/2016):

  • When you exercise your option to receive information from us;
  • When you submit your documents to us within Careers section, to express your interest in one of the collaboration opportunities under our Careers section.

Your consent can be withdrawn at any time by following the steps available in the indicated section. If at any time you opt-in to certain services or communications, such as newsletters, you will be able to unsubscribe at any time by following the instructions included in each communication.    c. In order to carry out the steps necessary to conclude a contract (according to art. 6 paragraph 1 letter b of Regulation 679/2016):

  • When, as a result of applying as a candidate for one of the positions available within the GĂNȚOI, FURCULIȚA ȘI ASOCIAȚII, according to the Careers section, we will contact you to continue the recruitment process;
  • When you request an offer of legal services from us, we will take steps to submit the offer and conclude the legal assistance contract.

 

   4. RECIPIENTS AND TRANSFER OF PERSONAL DATA

We may pass on information about you where necessary to meet our legal and regulatory obligations, as well as KYC (know your customer) obligations, to manage certain types of insurance policies or to provide hosting and support IT&C. However, we will ensure that the data transmitted is strictly necessary to fulfill one of the above purposes.

   5. DATA STORAGE PERIOD

After providing a service or applying for a position within our organization or responding to a request, we will retain your personal data only to comply with legal obligations and to defend our rights in the event of legal proceedings for a period of up to 5 (five) years from the time of collection.

The period for which the data is kept will depend on the nature and specific circumstances in which the information was collected.

If, as a result of the operations listed above, a new legal relationship will be initiated between you and GĂNȚOI, FURCULIȚA ȘI ASOCIAȚII, other retention periods will be applicable, in accordance with the legal provisions in force.

  • You have withdrawn your consent and there is no other legal basis for the processing;
  • You object to the processing of personal data;
  • Your personal data has been processed illegally;
  • Your personal data must be deleted to comply with a legal obligation.

  e. You have the right to oppose the processing of your personal data, for reasons related to a particular situation in which you are.

  f. You have the right to obtain the restriction of the processing of personal data in any of the following situations provided for in the GDPR, as follows:

  • Dispute the accuracy of the data. Processing will be restricted for the period of time necessary to verify the accuracy of the data;
  • The processing of your personal data is unlawful, but you choose to request its restriction rather than deletion;
  • Request the restriction to establish, exercise or defend a right in court;
  • You object to processing based on legitimate interest.

  g. You have the right to receive personal data concerning you in a structured format that is commonly used and can be read automatically and to transmit this data to another operator when the technical means allow this. This right can only be exercised when the processing is based on consent and is done by automated means.

  h. You have the right not to be subject to a decision based solely on automated processing, including profiling.

  i. You have the right to be notified in the event of security incidents affecting you.

You also have the right to file a complaint with the National Authority for the Supervision of Personal Data Processing (ANSPDCP) with headquarters in Blvd G-ral Gheorghe Magheru no. 28-30, Sector 1, Postal Code 010336, Bucharest, in the form of a written address at the institution's headquarters or electronically at anspdcp@dataprotection.ro, in case of a possible violation of your rights.

   7. DATA SECURITY

GĂNȚOI, FURCULIȚA ȘI ASOCIAȚII has implemented policies and procedures to protect personal information against loss, misuse, unauthorized modification or destruction. However, despite efforts to adhere to the highest standards, security cannot be absolutely guaranteed against all cyber threats.
